When the Auxiliary Fund provides compensation


The Auxiliary Fund shall be obliged to pay compensation to persons who have suffered damage due to death, bodily injury or material damage arising from motor vehicle accidents when:

a) The person liable remains unknown. In this case, however, there shall be no obligation to provide compensation for material damage, unless death or bodily injury requiring hospital treatment has occurred simultaneously, provided that a police authority has intervened and such treatment lasted for at least five days in a public hospital or private clinic.

b) The accident was caused by an uninsured vehicle or the liable vehicle is in a state of immobility.

Persons who voluntarily boarded the vehicle that caused the damage or bodily injury shall be excluded compensation, provided that the Auxiliary Fund proves that they were aware that the vehicle was uninsured.

c) The insurance undertaking has been placed under insurance liquidation, subject to the provisions of Articles 19a and 19b of Presidential Decree 237/1986.

d) The accident was caused by certain types of vehicles or specific vehicles bearing special registration plates, the civil liability of which had not been insured.

e) The accident was caused by a vehicle driven by a person who caused the accident intentionally, regardless of the manner in which possession of the vehicle was acquired.
